Pricing strategy. Market positioning. Negotiation. Managing inspections. Coordinating with lenders. Keeping timelines on track. Protecting my client\u2019s leverage.<\/p>\n\n\n\n<p>What I am not \u2014 and should never try to be \u2014 is an attorney.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Where a Realtor\u2019s Role Ends<\/h2>\n\n\n\n<p>Realtors are licensed to market and negotiate real estate.<\/p>\n\n\n\n<p>We are not licensed to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Interpret legal clauses beyond general explanation<\/li>\n\n\n\n<li>Draft custom legal language<\/li>\n\n\n\n<li>Give legal advice<\/li>\n\n\n\n<li>Resolve title disputes<\/li>\n\n\n\n<li>Handle complex contractual conflicts<\/li>\n\n\n\n<li>Structure legal protections in unusual situations<\/li>\n<\/ul>\n\n\n\n<p>Yet in many transactions, buyers and sellers lean entirely on their agent for answers that are fundamentally legal in nature.<\/p>\n\n\n\n<p>That\u2019s where risk enters the picture.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">An Attorney Is Not Optional Protection<\/h2>\n\n\n\n<p>In Florida especially, contracts carry serious legal weight.<\/p>\n\n\n\n<p>Inspection periods, financing contingencies, escrow disputes, default clauses \u2014 these aren\u2019t small technicalities. They determine who keeps deposits, who can cancel, and who is exposed financially.<\/p>\n\n\n\n<p>A real estate attorney reviews:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The contract language<\/li>\n\n\n\n<li>Title commitments<\/li>\n\n\n\n<li>Liens or encumbrances<\/li>\n\n\n\n<li>Association documents<\/li>\n\n\n\n<li>Addendums and amendments<\/li>\n\n\n\n<li>Closing statements<\/li>\n<\/ul>\n\n\n\n<p>They are trained to see risk where others see paperwork.<\/p>\n\n\n\n<p>In many cases, the attorney\u2019s role is as important as the Realtor\u2019s \u2014 and sometimes even more critical.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Realtor and Attorney Should Work Together<\/h2>\n\n\n\n<p>A strong transaction isn\u2019t about choosing one professional over another.<\/p>\n\n\n\n<p>It\u2019s about building the right team.<\/p>\n\n\n\n<p>The Realtor drives:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Market strategy<\/li>\n\n\n\n<li>Pricing<\/li>\n\n\n\n<li>Exposure<\/li>\n\n\n\n<li>Negotiation<\/li>\n\n\n\n<li>Timeline management<\/li>\n<\/ul>\n\n\n\n<p>The attorney protects:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Legal structure<\/li>\n\n\n\n<li>Risk exposure<\/li>\n\n\n\n<li>Contract clarity<\/li>\n\n\n\n<li>Asset protection<\/li>\n<\/ul>\n\n\n\n<p>When those two roles are aligned, the client wins.<\/p>\n\n\n\n<p>When either one tries to replace the other, problems start.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Bottom Line<\/h2>\n\n\n\n<p>A home purchase or sale is often the largest financial transaction of someone\u2019s life.<\/p>\n\n\n\n<p>It deserves:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Strategic representation<\/li>\n\n\n\n<li>Legal protection<\/li>\n\n\n\n<li>Clear communication<\/li>\n\n\n\n<li>Defined roles<\/li>\n<\/ul>\n\n\n\n<p>A Realtor has a plethora of responsibilities in the real estate process.<\/p>\n\n\n\n<p>Practicing law should not be one of them.<\/p>\n\n\n\n<p>If you&#8217;re considering buying or selling in Fort Lauderdale and want a properly structured team approach, I\u2019m happy to walk you through how the process should be handled \u2014 the right way.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A real estate transaction looks simple from the outside.
